Competition Period

12.01am (AEST) on 07/08/2023 to 11.59pm (AEDT) on 30/10/2023.

Who can enter?

Only Australian residents who are aged 18 or over.

Who can't enter?

Directors, officers, management and employees (and their immediate families) of:

  1. the Promoter;
  2. Immediate Pty Ltd (Immediate);
  3. Coles Supermarkets Pty Ltd; and
  4. the agencies, companies, contractors or participating premises associated with this competition.

Where will the competition run?

The competition will run in participating Coles stores (including Coles Express, Coles Local and Coles online) (Stores) in Australia.

For the avoidance of doubt, warehouses servicing Coles online are considered Stores, for the purpose of this competition.

Qualifying Purchase

A specially marked CADBURY DAIRY MILK, CADBURY CARAMILK or OLD GOLD block (from the list below) from a Store:

  • CADBURY DAIRY MILK MILK CHOCOLATE 180g or 360g
  • CADBURY DAIRY MILK CARAMELLO 180g
  • CADBURY DAIRY MILK TOP DECK 180g
  • CADBURY DAIRY MILK HAZELNUT 180g
  • CADBURY CARAMILK 180g
  • OLD GOLD OLD JAMAICA RUM N RAISIN 180g
  • OLD GOLD ROAST ALMOND 180g

For the avoidance of doubt, a Qualifying Purchase can only be made during the Competition Period.

Entry instructions

You must, during the Competition Period:

  1. make a Qualifying Purchase from a Store and collect your itemised purchase receipt;
  2. open the packaging of the Qualifying Purchase product to see if a promotional winning ticket is inside (and, if so, this is a Winning Ticket); and
    1. if you have a Winning Ticket, follow the instructions outlined below to claim your instant prize before the Claim Date and to be entered into the major prize draw (for entries received by 11.59pm (AEDT) on 30/10/2023); or
    2. if you do not have a Winning Ticket, visit the Website, locate the entry page and fill out and submit the entry form in accordance with the instructions provided, including by uploading an image of the Qualifying Purchase receipt and providing all other requested information to enter the major prize draw.

If your Qualifying Purchase has a Winning Ticket, to claim the instant win prize you must, by 11.59pm (AEDT) on 05/02/2024 (Claim Date), visit the Website, locate the claim page and fill out and submit the online claim form in accordance with the instructions provided, including by providing the unique code on the Winning Ticket, uploading an image of the Qualifying Purchase receipt, uploading an image of the Winning Ticket, uploading an image of the back of the Qualifying Purchase pack showing the batch code and product barcode (as shown on the claim form), and providing all other requested information. Winners will be required to provide details of a valid Australian bank account in order to claim their instant prize. If a winner fails to provide the required bank account details they will forfeit their instant prize and no substitute prize will be offered. After the Claim Date, Winning Tickets will be void and cannot be used to claim an instant prize.

Your purchase receipt must clearly identify the Store where the Qualifying Purchase was made, the product/s purchased (which must be a Qualifying Purchase) and the date of purchase (which must be during the Competition Period before you submitted your claim/entry). If you have a Winning Ticket, the purchase receipt must match the Promoter's records in terms of where a Qualifying Purchase containing a Winning Ticket was available at that time. The Winning Ticket must be a genuine Winning Ticket and must clearly show the unique code as specified on the claim form.

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting a claim/entry, including having the requisite photograph capability.

All instant prize claims will be verified by the Promoter (Verification).

If you do not have a Winning Ticket and choose to enter the major prize draw, you will also be automatically entered into the second chance draw.

For the avoidance of doubt, if you submit your instant win prize claim outside of the Competition Period, you will not receive an entry into the major prize draw.

How many winners will there be and how will they be chosen?

There will be 291 winners determined in respect of this competition - 290 instant winners and 1 major winner.

Instant prizes

There will be a total of 290 Winning Tickets (which will correspond to an instant prize) distributed to randomly selected Stores throughout the Competition Period, selected by a computerised random system at Immediate, 111/87 Gladstone Street, South Melbourne VIC 3206 (Immediate).

Winning Tickets will be randomly allocated to Stores as follows:

Coles Express

15 Winning Tickets

All other Coles Stores including Coles online and Coles Local

275 Winning Tickets

Instant prizes will be awarded to winners via EFT to the winner's nominated Australian bank account within 28 business days from receipt of bank details.

Major prize

The major draw will be held at 11am (AEDT) on 01/11/2023 at Immediate.

The first valid entry drawn randomly from the entries received during the Competition Period (including instant prize winners) will win the major prize.

The Promoter may draw additional reserve entries in the major draw and record them in order in case the winning entry/entrant is deemed invalid or the major prize is unclaimed (Reserve Entrants).

What can I win?

There are 291 prizes available.

Each instant prize is $1,000 cash, awarded via EFT.

The major prize is a trip for 2 adults and 2 children to an Australian capital city (as determined by the Promoter) to see a CommBank Matildas International Friendly game in Australia in 2023/24 (exact game, date and location to be confirmed by the Promoter) and tickets to that game, valued at up to $10,000 depending on the winner's point of departure.

Major prize

If you win the major prize, your prize will be a trip for you, and 3 companions (total 2 adults and 2 children) to an Australian capital city (as determined by the Promoter) valued at up to $10,000 which includes the following:

  1. return economy airfares (including airfare taxes) from your nearest Australian capital city to either Brisbane, Sydney, Melbourne, Adelaide or Perth (depending on where the CommBank Matildas International Friendly game selected by the Promoter is being held) and return transfers between the destination airport and the accommodation (flights are not included if you live in in the same capital state/city where the game is being held, however the Promoter will provide up to $250 (in total) for you and your companions to make your own way to and from the accommodation);
  2. 3 nights' accommodation in a family room at minimum 4 star hotel or accommodation equivalent (as determined by the Promoter) for you and your companions;
  3. tickets for 2 adults and 2 children to a 2023/24 CommBank Matildas International Friendly game in Australia, as determined by the Promoter (exact game, date and location to be confirmed by Promoter); and
  4. $1,000 spending money for you only awarded via EFT to your nominated Australian bank account.

For the avoidance of doubt, the game tickets are not for any games played in the 2023 FIFA Women's World Cup™. The CommBank Matildas game tickets are subject to fixture changes and availability. In the event that there are no CommBank Matildas International Friendly games held in Australia during the 2023/24 season, the Promoter will provide the winner with a cash alternative of $10,000 which will be awarded via EFT to the winner's nominated Australian bank account within 28 business days from receipt of bank details.

This major prize is subject to a pandemic, any travel/government restrictions/directives, border closures, health advice and the like.

By accepting or participating in any prize, your companions accept these Terms and Conditions.

Total prize pool

The instant win prize pool is $290,000.

The major prize pool is up to $10,000.

The total prize pool is up to $300,000.

How many times can I enter?

Instant win

You can claim multiple instant win prizes, provided each claim corresponds to a unique Winning Ticket. Each claim must be submitted separately in accordance with these Terms and Conditions.

Major prize draw

There is a limit of 5 major prize draw entries per household as determined by residential address. Each entry must correspond to a separate Qualifying Purchase product and be submitted separately in accordance with these Terms and Conditions.

How and when will the instant winner/s be informed?

Instant winners

After Verification, instant winners will be notified in writing by email within four business days of Verification.

Instant winners will have their first initial, surname and the Store they made their purchase in published on the Website within two business days of Verification for a period of 28 days.

Major winner

The major prize winner will be notified by phone and in writing within two business days of determination and will have their first initial, surname and state/territory of residence published on the Website on 03/11/2023 for a period of 28 days.

Proof of purchase

You must keep the following as proof of purchase for all claims/entries:

  • original itemised purchase receipt(s) (clearly showing Qualifying Purchase product, date and time of purchase, Store address and Store number); and
  • Winning Ticket/s (if found) (intact and clearly showing the unique number as submitted with your claim); and
  • if you have found a Winning Ticket/s, the Promotional packaging of that Qualifying Purchase.

If you don't produce the above proof of purchase for all claims/entries when asked, the Promoter may disqualify all of your claims/entries and you will lose any right to a prize.

Proof of purchase must be identical to that provided by you with your claim/entry.

If, in the Promoter's opinion, you have shared any proof of purchase with another person, or if you have benefitted from the sharing of proof of purchase in any way, all relevant claims/entries will be invalid and all relevant persons will lose any right to a prize.

Unclaimed major prize draw and second chance draw for instant win prizes

Unclaimed major prize draw

Major prize claim date: 5pm (AEDT) on 14/11/2023.

Unclaimed major prize determination: 11am (AEDT) on 15/11/2023 at Immediate.

If the major prize has not been accepted or claimed by the major prize claim date above or if, after making all reasonable attempts, the Promoter can't contact the major prize winner (or the major prize winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will re-award the major prize to a Reserve Entrant and/or carry out an unclaimed major prize draw at the date, time and place stated above to randomly distribute the major prize. Any winner will be informed by phone and in writing within two business days of determination and will also have their first initial, surname and state/territory of residence published on the Website on 17/11/2023 for a period of 28 days.

Second chance draw for instant win prizes

If any instant win prize is un-won or not claimed by the Claim Date, a second chance draw will be held at 12pm (AEDT) on 15/02/2024 at Immediate. Each un-won or unclaimed prize will be distributed to the next valid second chance draw entry randomly drawn until all un-won and unclaimed instant prizes are awarded. Any winner/s in this draw will be informed in writing by email within four business days of determination. Winner/s will have their first initial, surname and the Store they made their purchase in published on the Website on 22/02/2024 for a period of 28 days.

If a second chance prize has not been accepted or claimed by 12pm (AEDT) on 07/03/2024 or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by 12pm (AEDT) on 08/03/2024, the relevant entry/ies will be discarded, and the Promoter will forfeit the prize/s from the prize pool.

If any prize remains un-won at the end of this promotion, or if a prize winner cannot be found, that information will be published on the Website on 11/04/2024.


Collection and use of your personal information

If you are a winner, you/your companions (if applicable) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You/your companions consent to the Promoter using your name/s and image/s in any promotional or advertising activity.

The Promoter may collect your/your companions' personal information directly or through its agents or contractors. The Promoter will use your/your companions' personal information to conduct and manage the competition. The Promoter may disclose your/your companions' personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you/your companions or storing data. This may include disclosures to organisations outside Australia including in places such as New Zealand, Switzerland, Singapore, United Kingdom and the United States of America.

The Promoter's Privacy Policy (see au.mondelezinternational.com/privacy-policy) includes information about:

  1. how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
  2. how to complain about a privacy breach and how the Promoter will deal with such a complaint.

  1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By participating, you accept these Terms and Conditions.

Entry/Claim

  1. Your instant win claim must be received by the Claim Date and will be deemed to be received only when received by the Promoter. Your major prize entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. If you return a Qualifying Purchase your claim/entry may be deemed invalid at the Promoter's discretion (unless the product is defective). You will receive a return message confirming your claim/entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with claiming/entering. If you enter using automatically generated claims/entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

Prizes

  1. Prizes and all elements of prizes must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:
    1. booking and availability of flights, accommodation and events;
    2. conditions of travel and conditions of entry into any event venues (including behaviour/COVID safety requirements and applicable dress codes);
    3. conditions of ticket validity and any restrictions on ticket on-sale or transfer;
    4. travel dates and specified travel exclusion periods;
    5. any additional fees (payable by you) relating to changes made by you/your companions to the major prize after it has been booked;
    6. a requirement to present your credit card when checking in to accommodation; and
    7. a requirement that any person taking the prize that is aged under 18 years old must be accompanied by their parent or guardian at all times.
  2. If you win the major prize, you/your companions are responsible for all other unspecified costs related to the major prize, including meals, transport, insurance (including excesses), in-room charges, additional taxes, etc.
  3. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.
  4. The Promoter accepts no responsibility if one or more of the events or activities awarded as part of the major prize are abandoned, called off or postponed for any reason. In that case you/your companions forfeit your entitlement to that event/activity. Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element.

General

  1. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).
  2. If you or your claim/entry are deemed by the Promoter to breach these Terms and Conditions, your claim/entry (or at the Promoter's discretion, all of your claims/entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your claims/entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  3. You must not:
    1. tamper with the claim/entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the claim/entry process);
    2. engage in any conduct that may jeopardise the fair and proper conduct of the competition;
    3. act in a disruptive, annoying, threatening, abusive or harassing manner;
    4. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
    5. breach any law; or
    6. behave in a way that is otherwise inappropriate.
  4. If you win the major prize, you are responsible for your companions and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or any or all of your companion/s if they breach these conditions, whether or not legally bound by them.
  5. If you win the major prize, if you (or your companions, if applicable), in the opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companions) from participating in any elements of the major prize, at its discretion.
  6. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
  7. If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter's decision in connection with all aspects of this promotion is final.
  8. Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
  9. By claiming or entering, you request that your full address not be published.
  10. Printing and other quality control errors outside the Promoter's control will not invalidate an otherwise valid prize claim. Every instant win prize claim in excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.
  11. If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, pandemic, public health orders and the like, the Promoter may end, change, suspend or cancel the competition or disqualify affected claims/entrants, subject to any necessary approval by the state/territory gaming authorities.
  12. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

Liability

  1. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
  2. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury(including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  3. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes. Unless otherwise specified, prizes will only be delivered to addresses in Australia.
  4. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
